TERMS OF SERVICE

These Terms govern the purchase and use of products sold by Vibly (“we”, “us”, “our”). By placing an order, you agree to these Terms.
If you do not agree, you must not use our services.
1. Status as Retailer
Vibly operates solely as a retailer.
We do not manufacture the products sold. All manufacturing responsibility, including materials, production standards, safety engineering, and technical design, rests exclusively with the original third-party manufacturer.
We rely on supplier-provided compliance documentation and declarations.
Nothing in this clause affects your statutory rights.
2. Intended Domestic Use Only
Products are intended strictly for normal domestic household use unless expressly stated otherwise.
The following constitute misuse:

Commercial or industrial use

Modification or alteration
-
Unauthorised repair
-
Use with incompatible electrical systems
-
Use contrary to provided instructions
-
Use in unsafe or abnormal conditions
We are not liable for damage arising from misuse.
3. Electrical & Heat-Generating Product Safety
Electrical products must:

Be used only with compatible voltage and plug standards
-
Never be left unattended during operation
-
Be kept away from flammable materials
-
Be allowed adequate cooling intervals
-
Be used on stable, heat-resistant surfaces
If abnormal heat, smoke, unusual odour, malfunction, or electrical irregularity occurs, use must cease immediately.
Failure to follow these requirements constitutes improper use.
4. Installation & Compatibility Disclaimer
The customer is responsible for ensuring:

Electrical compatibility with local mains supply

Proper voltage suitability
-
Safe installation and placement
We are not responsible for damage caused by:

Incorrect voltage
-
Improper plug adapters
-
Third-party accessories
-
Unauthorised modifications
5. Inspection Upon Delivery
The customer must inspect the product promptly upon receipt.
Any visible defect, transit damage, or issue must be reported within a reasonable time.
Continued use of a product after discovering a defect may limit available remedies where permitted by law.
6. Warranty & Remedies
Products are provided in accordance with applicable UK statutory rights.
Where a product is defective and verified as such:
We may, at our discretion and in accordance with law:

Repair the product

Replace the product
-
Issue a refund
Remedies are limited to the value of the product purchased.
This clause does not affect statutory consumer rights under the Consumer Rights Act 2015.
7. Assumption of Risk
Certain products, particularly electrical or heat-generating devices, carry inherent risks if misused.
By purchasing and using our products, you acknowledge responsibility for:

Nothing in this clause excludes liability where unlawful.
8. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for:

Damage arising from unauthorised modification

Damage resulting from failure to follow instructions
Our total liability shall not exceed the purchase price paid.
Nothing in these Terms excludes liability for:

Any liability that cannot legally be excluded
9. No Guarantee of Absolute Safety
No electrical or mechanical product can be guaranteed entirely risk-free.
Safe operation depends on:

Proper use

Compliance with instructions
-
Reasonable supervision
10. Risk Transfer
Risk in the goods passes to the customer upon confirmed delivery to the shipping address provided at checkout.
The customer is responsible for safe storage and handling after delivery.
11. Product Description & Illustrations
Product images are for illustrative purposes only.
Minor variations in appearance, packaging, or design that do not affect functionality shall not constitute a defect.
Descriptions are provided in good faith but may vary slightly due to manufacturer updates.
12. Indemnity (Permitted Scope)
You agree not to hold Vibly responsible for claims arising solely from your misuse, negligence, or failure to follow instructions.
This clause applies only to the extent permitted under UK law.
13. Force Majeure
We shall not be liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to:

Natural disasters

Government restrictions

Supply chain disruption

Transport interruption

Industrial disputes
14. Entire Agreement
These Terms constitute the entire agreement between you and Vibly regarding the purchase and use of our products.
No oral statement or prior representation shall form part of the agreement.
15. Variation of Terms
We reserve the right to amend these Terms at any time.
The version in effect at the time of purchase shall apply to that transaction.
16. Statutory Rights
Nothing in these Terms affects your statutory rights under:

Consumer Rights Act 2015

Consumer Protection Act 1987
-
Electrical Equipment (Safety) Regulations 2016

Any other applicable UK legislation
Where conflict exists, statutory rights prevail.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
18. Severability
If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
